THE justice department absolved Senator-elect Gringo Honasan of criminal liability, but reaffirmed the rebellion charges against Lt./SG Antonio Trillanes IV and other members of the so-called Magdalo soldiers who joined the Oakwood mutiny on July 27, 2003.
Justice Secretary Raul Gonzalez recommended the dropping of rebellion charges against Honasan for lack of evidence, and following Honasan’s plea that the justice department reconsider its resolution finding probable cause to indict him as the main architect of the failed mutiny.
“After judicious review of the record, there being an insufficiency of evidence, the petition for review is granted, and the complaint against respondent is dismissed,” Gonzalez said.
As to reports that Malacanang had considered granting amnesty to Trillanes, Trillanes has turned down the offer and his lawyer had said that accepting amnesty would be tantamount to owning up to the charges that the government had files against him.

The softening of the administration’s stance against the Oakwood mutineers is a political ploy to counter the growing support for the military rebels, as shown by the results of the recent elections.
Now that the military top brass has been subtlely supporting Trillanes, and indications that Trillanes’ victory was in fact helped by soldiers in the field, the administration is playing the cards wisely to ensure its survival.
By welcoming Trillanes and Honasan into the fold of the democratic system, the government hopes to game them into hoping that reforms could be achieved through the legislation and not by military uprising.
Conclusion:
While there could be stability in the near future with the administrations’ peace overtures, it’s a sign of weakness on the part of the government in the face of the undercurrent military restiveness and the rebels’ victory in the elections. This could embolden junior officers to follow the Honasan and Trillanes path, when they now realize that it does pay off to become rebellious, and it pays handsomely. You don’t even have to fire a single shot to stage a mutiny, and months later, you become a senator.
