Was it consensual or was it rape?
Lance Corporal Daniel Smith, one of the suspects in the alleged rape of a 22-year-old woman in Olongapo City by four visiting U.S. Marines last year, has claimed in court that Nicole (not her real name) had agreed to have sex with him, even helping him put on a condom.
Smith says, in response to questioning from his lawyers:
I kind of asked jokingly if she wanted sex here [in the van]. She said ‘yes’ …. I kind of looked surprised. So I started to get undressed and she was doing the same.”
“She assisted me [to] put the condom on. She had her hands on my penis. She leaned back and, assisted me in entering her.”
He adds:
“We were having a nice time. At the time, she did seem to like me as well.”
The alleged rape took place inside a moving van outside the former Subic Naval Base, where the soldiers were staying for a joint military exercise with their Filipino counterparts. The other accused are Lance Corporals Dominic Duplantis and Keith Silkwood and Staff Sergeant Chad Carpentier.
The woman said he met four US Marines in a bar where they had drinks, after which Smith allegedly raped here inside a moving van while the three other soldiers cheered him on. She was then left by the roadside, naked waist down with her pants around her ankles.
The prosecutors’ main line of attack that the victim was drunk only weakens their case, since that would only bolster the defendants’ claim that she was not forced to have sex. Even the victim is not happy with the way her lawyers were prosecuting the case. She walked out on them on Friday.
She says:
…the public prosecutors are incompetent.
Fearless forecast: This case will end in an acquittal or drag on for years.

i think nicole is a bag of lies. im a guy so i know and its scary to be accused of rape after romping while drunk.
I think she is not a rape victim…a decent woman should not be found in the house of ill dispute place. This guy are in that place for one reason they want to find a mating partner. In cases like this.. girls are always in an awfull situation. So, why would a girl accused somthing like this to a person when all she can get is shame. Despite of all the mocking she received from PEOPLE like you (i_am_ice & ignas) she still continue the fight for just ONE REASON!! AND THAT IS JUSTICE!!..
Its not an excuse if they are americans and their culture is different from us FILIPINO’s.. the fact that they are here in Philippines they should respect the people lived here and thats including FILIPINA’s. AMERICANS ABUSED OUR FILIPINA’S and that is fact. They are nothing but an animal.. The people who abused nicole should be in ONE PLACE ONLY!! and thats be IN JAIL!!!!
American soldiers admit if they see a troop member commit a murder (outside of battle). Marines are very honorable soldiers. I think at least 1 from the van would agree with the girl if she were indeed raped.
And I dont mean to be insulting but Pinays are very sexually aggressive and open. My first Pinay gf was a missionary and I got sick of her because she always wanted sex out of wedlock against God’s law. I think many pinays try to use sex as a weapon or tool. I have a beautiful Pinay gf now and even when we were arguing she always initiated sex even if I tried to sleep in a different room. Thats just my perspective.
Dont hate us Americans. Americans definitely commit crimes and make great mistakes in judgement and morals sometimes. We are all humans. There are nasty lying Pinoys, but when I meet a Pinoy, he deserves to be respected and taken individually until he breaks my trust, and many never do!

i’m a filipina. and i’m finding it hard to believe “Nicole’s” version of the story. if i go to clubs, i go with my friends and leave with them. and i don’t get too tipsy to oblivion… She went with her sis, right? where then was her sis when she was dragged/pulled out of the club and into the van? surely, there’s more to the story there.

Nicole is a flirt and a slut. Facts: she had sex with an American boy, and she felt his dick. If there’s any truth to penetration, lucky for her. But the point of accusing him of rape is just insane and very hyprocritical of her! She did not behave appropriately at all as a respectful, decent woman in the bar. She was flirting, indicating a woman who itches for a Caucasian dick to blow or feel inside her. Her motivation for accusing the American boy? Vengeance for her and her family’s disgraced reputation after being she was found almost naked on the street with people looking at her.
