KABUNTALAN, Maguindanao — To break a one-in-a-million tie, two politicians will draw lots to determine who between them will be mayor of this town.
This was the decision reached by election officials yesterday after mayoral aspirants Alimudin Macacua and Mike Fermin finished with 2,208 votes each after two rounds of voting.
Seen as a highly emotional way of resolving an electoral deadlock but one that was provided for under the law, the drawing of lots is scheduled for May 14 at the provincial capitol in Shariff Aguak town. It could be the first time such a draw is being held in the country’s electoral history.
What the law says
Section 240 of the Election Code provides that “whenever it shall appear from the canvass that two or more candidates have received an equal and highest number of votes … the board of canvassers shall proceed to the drawing of lots by the candidates who have tied and shall proclaim as elected the candidates who may be favored by luck.”
Commission on Elections (Comelec) officials in Manila said there had been cases of elections being decided by the luck of the draw, but they involved contests at the barangay level.
